TERMS AND CONDITIONS OF SERVICE

1. GENERAL
These Terms and Conditions ("Terms") govern all services provided by Praise Plumbing LTD ("Contractor", "we", "us") to the client identified in the quote, work order, or invoice ("Client", "you"). By authorizing us to perform work (verbally, by email, or by signing a quote), you agree to be bound by these Terms.
2. ESTIMATES & QUOTES
• Validity: All estimates/quotes are valid for 30 days from the date of issue. After 30 days, we reserve the right to update pricing based on current material and labour costs.
• Not a Fixed Price: Unless explicitly stated as a "Fixed Price Quote," estimates are non-binding approximations of cost. Final invoicing will reflect actual labour hours and materials used.
• Unforeseen Conditions: Plumbing work often reveals hidden issues (e.g., rotted subfloors, non-compliant previous work, hidden pipe corrosion). If unforeseen conditions arise, we will stop work, inform you, and provide a revised estimate. Work will only proceed upon your approval.
3. PAYMENT TERMS
• Standard Terms: Payment is due upon [Receipt / Completion of Work].
• Deposits: For projects exceeding $1000, a deposit of [30]% is required before work is scheduled or materials are ordered. For projects exceeding $5000, a deposit of [50]% is required before work is scheduled or materials are ordered.
• Late Payments: In accordance with BC business standards, accounts overdue by more than [30] days will be subject to a late fee of 2% per month (26.8% per annum) or the maximum allowable by law.
• Title to Goods: All parts, fixtures, and materials remain the property of [Your Business Name] until the invoice is paid in full. We reserve the right to reclaim unpaid materials where legally permissible.
4. WARRANTY & GUARANTEE
• Workmanship Warranty: We provide a [1-Year] warranty on all labour/workmanship from the date of completion. If a defect in our workmanship is found, we will repair it at no cost to you.
• Material Warranty: Materials and fixtures are covered solely by the manufacturer’s warranty. We do not warranty parts themselves, but we will assist you in processing manufacturer claims where possible.
• Exclusions:
• Drain Cleaning: Due to the nature of root intrusion and older piping, we do not offer a warranty on drain cleaning or unblocking services. Blockages can reoccur immediately if the underlying cause (e.g., roots, broken pipe) is not repaired.
• Client-Supplied Parts: We offer NO warranty (labour or materials) on parts or fixtures supplied by the Client. If a client-supplied part fails, you will be charged standard labour rates for us to return and fix it.
• Freeze Damage: We are not responsible for frozen pipes or weather-related damage unless caused directly by our negligence.
5. ACCESS & SITE CONDITIONS
• Access: The Client agrees to provide clear, safe access to the work area. The Client must secure all pets and remove personal property from the immediate work zone.
• Asbestos/Hazardous Materials: If asbestos or other hazardous materials are discovered, we are required by WorkSafeBC regulations to stop work immediately. Remediation is the Client’s responsibility and cost.
• Water Shut-Off: It is the Client's responsibility to know where the main water shut-off is. If the main shut-off is seized or inoperable, we may need to replace it at an additional cost before commencing other work.
6. LIMITATION OF LIABILITY
• Pre-Existing Conditions: Plumbing systems in Victoria can be older. We exercise reasonable care, but we are not liable for damages to surrounding areas (drywall, flooring, cabinets) or plumbing components that fail due to age, corrosion, or pre-existing defects during standard repair work.
• Incidental Damage: We are not liable for incidental water damage that occurs during the course of a repair (e.g., residual water in pipes) unless due to gross negligence.
• Concrete/Landscaping: If excavation is required, we will backfill the trench, but we are not responsible for replacing landscaping, grass, concrete, or asphalt unless specifically listed in the Quote.
7. CANCELLATION & RESCHEDULING
• Notice: We require at least 24 hours' notice to cancel or reschedule an appointment.
• Fees: Cancellations made with less than 24 hours' notice may be subject to a Standard Call-Out Fee ($[Amount]).
• Non-Entry: If we arrive at the scheduled time and cannot gain access, the Standard Call-Out Fee will apply.
8. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of British Columbia and the federal laws of Canada applicable therein. Any disputes will be resolved in the courts of Victoria, BC.
